Artificial intelligence (AI) has become an integral part of our lives, revolutionising various industries, and enhancing our daily experiences. From voice assistants like Siri and Alexa to self-driving cars and personalised recommendations, AI has undoubtedly transformed the way we interact with technology. However, with the increasing reliance on AI, there are significant data protection risks that organisations need to consider and manage.

It is certainly true that such AI processing comes with ethical, security, transparency and wider compliance risks. Ensure that you complete a data protection impact assessment (DPIA) prior to implementing AI.

In early October, the ICO issued Snap with a preliminary enforcement notice over potential failure to properly assess the privacy risks posed by its generative AI chatbot ‘My AI.’ We are not clear what the enforcement will look like, if it does indeed go ahead. The ICO have been clear in their publication that the findings are provisional at this stage.
